The Supreme Court dismissed as inadmissible the preliminary reference (hotărâre prealabilă) submitted by the Bucharest Court of Appeal regarding the interpretation of a prior judicial decision on the salary of justice personnel. The dispute concerned whether Decision No. 36/2018 established judicial precedent as a source of law for the remuneration of staff in the justice system, a question the higher court declined to answer. The ruling, issued under Article 521(3) of the Civil Procedure Code, is mandatory and final, leaving the lower court's pending case unresolved on this specific interpretive issue while maintaining the status quo of the referenced norms.
