The High Court of Cassation and Justice dismissed the reference question submitted by the Court of Appeal Piteşti as inadmissible, leaving no decision on the merits of the underlying legal issue. The dispute concerned the interpretation of Article 52(4) of Law No. 80/1995 regarding the status of military personnel, specifically whether provisions introduced by Law No. 101/2019 apply retroactively to officers who transferred to the officer corps prior to that law's enactment. The rejection was based on procedural grounds under Article 521(3) of the Civil Procedure Code, which governs the admissibility of preliminary questions for the resolution of legal issues.
