The High Court of Cassation and Justice upheld the preliminary question referred by the Iaș Appeal Court, establishing that specific salary rights for public education personnel are subject to statutory limitations. The dispute concerned the interpretation and application of salary provisions under the Framework Law on Public Sector Pay, specifically whether the salary rights regulated by Articles 5 and 8 of Annex I (Family of Budgetary Functions "Education," Chapter I, Lit. B) of Law No. 153/2017 fall under the scope of Article 38(4¹). Relying on Article 38(4¹) of Law No. 153/2017 in conjunction with Article 34(2) of Emergency Ordinance No. 114/2018, the court ruled that these educational sector salary rights are indeed subject to the restrictions and measures imposed by the cited legislative provisions.
