The High Court of Cassation and Justice rejected as inadmissible the referral by the Court of Appeal regarding the interpretation of Article 460 of the Code of Civil Procedure concerning the applicable avenue and deadline for appeal when a single judgment resolves multiple principal claims with differing admissibility to cassation. The dispute arose from a procedural question regarding the determination of appeal rights and deadlines in consolidated civil proceedings where some claims are appealable only by appeal and others by both appeal and cassation. The decisive legal basis was the procedural provision of Article 521(3) of the Code of Civil Procedure, which governed the admissibility requirements for the preliminary decision, leading to the dismissal of the request without a substantive ruling on the underlying procedural conflict.
