The High Court of Cassation and Justice (Civil Section I) declined its own jurisdiction over a request for the transfer of a case (strămutare) from the Argeș Tribunal to another court of the same level, based on legitimate suspicion, and referred the matter for resolution to the Pitești Court of Appeal; the decision is final and without appeal, meaning the Pitești Court of Appeal will now decide the transfer request. The applicant had filed the transfer request on 27 November 2019 concerning a case registered on 24 April 2015, which the court found to be governed by the new Code of Civil Procedure (Law No. 134/2010) under Articles 24–25. Applying Article 142(1) of the Code, the court held that a request for transfer based on legitimate suspicion must be decided by the court of appeal having territorial jurisdiction over the court from which transfer is sought, and since the Argeș Tribunal falls within the territorial jurisdiction of the Pitești Court of Appeal, that appellate court is the competent forum to adjudicate the matter.
