Transfer of civil case: material jurisdiction for legitimate suspicion requests against first-instance courts
Legislator summary
AI generatedThe High Court of Cassation and Justice ordered the declination of jurisdiction, transferring the case to the Craiova Court of Appeal without prejudice to the merits, thereby denying the applicant's implicit request for immediate review at the supreme level. The dispute involved a procedural motion by a limited liability company in liquidation to transfer a civil case pending at the Drobeta-Turnu Severin Court of First Instance to a different court due to legitimate suspicion of bias. Applying Article 142(1) of the Civil Procedure Code, the court determined that requests for transfer based on legitimate suspicion regarding decisions by a first-instance court fall within the exclusive material jurisdiction of the corresponding court of appeal, not the High Court, which therefore lacked competence to adjudicate the substantive request and was bound to refer the matter to the competent appellate authority.
