Admissibility of lawyer-certified private deeds and public register status: reference for preliminary ruling declared inadmissible
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible a reference for a preliminary ruling submitted by the Bucharest Court of Appeal regarding two questions of law. The reference concerned whether the Register of Deeds Certified by Attorneys (introduced by Law No. 51/1995) was legally a public register prior to May 29, 2018, when the National Register of Deeds Certified by Attorneys was operationalized, and whether Article 3(1)(c) of Law No. 51/1995 permits attorneys to certify the date of private written instruments. By rejecting the referral, the court ordered that the referring appellate court must continue to handle the underlying civil dispute without binding guidance from the Plenary Court on these specific interpretative issues.
