The High Court of Cassation and Justice rejected as inadmissible the referral for a preliminary ruling on questions of law submitted by the Bucharest Court of Appeal, meaning the lower court’s referral failed and the underlying dispute must proceed without the requested interpretative clarification. The case involved a challenge to the application of consumer protection and banking regulations in an administrative and fiscal proceeding, specifically concerning the contractual charging of penalty interest in financial service contracts. The submitted legal questions sought interpretation of Article 7(c) of Government Ordinance No. 21/1992 regarding whether penalty interest constitutes a service not affecting consumer health or security, the applicability of Article 3(1) of Law No. 313/1879 to credit contracts between financial institutions and individuals, and the permissibility of administrative recalculation and restitution of penalty interest under Articles 14-15 of Government Ordinance No. 21/1992. The court’s decision rests on the procedural admissibility requirements under Article 521(3) of the Civil Procedure Code, which governed the viability of the preliminary reference request.
