The High Court of Cassation and Justice admitted the appeal in the interest of law filed by the appellate court's executive board, establishing binding interpretations for land reprivatization cases. The dispute centered on the interpretation of statutory provisions governing the restitution of agricultural and forest lands to religious structures, specifically regarding the scope of "church fund," the definition of historical ownership, and the calculation of surface areas under pre-amendment legal regimes. The Court ruled that absolute nullity of title is not admissible based solely on Protocol No. 1 to the European Convention on Human Rights, but established that "church fund" refers exclusively to the patrimony of Romanian Orthodox Church units, excluding foundations; "had in property" requires a perfected property right consistent with the 1864 Civil Code rather than historical forms; and the relevant surface area for forest lands is limited to those in the individual legal entity's endowment, administration, or use, not the broader religious cult's holdings. These clarifications apply to the interpretation of Articles III and 29 of Land Law No. 18/1991 and Law No. 1/2000, affirming the procedural outcome of the specific appeal while setting mandatory legal standards for future similar disputes.

ÎNALTA CURTE DE CASAŢIE ŞI JUSTIŢIE

Completul pentru soluționarea recursului în interesul legii

Minuta deciziei nr. 29 Dosar nr. 2095/1/2020

Şedinţa din 9 noiembrie 2020

ÎN NUMELE LEGII

DECIDE:

517 alin. (4) din Codul de procedură civilă.

Pronunţată în şedinţă publică astăzi, 9 noiembrie 2020.
