The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference filed by the Bucharest Court of Appeal, thereby denying the appellate court's request for a preliminary ruling and leaving the lower instance to resolve the case without a definitive legal interpretation from the supreme instance. The dispute concerned the application of Article 12(3) of Law No. 393/2004 on the Statute of Local Elected Officials, specifically whether a county prefect is legally obligated to verify the finality of a councilor's exclusion from their political party within the party's internal appeal system and to request justificatory documents regarding the exclusion procedure before acting on such matters. The decisive legal basis was the procedural inadmissibility of the reference under the Civil Code of Procedure (Article 521(3)), which governs the conditions for the High Court to rule on questions of law raised by lower courts.
