Cumulation of statutory weekly rest day bonuses and overtime compensation for special-status penitentiary officials
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the referral from the Bucharest Court of Appeal and established binding legal interpretation, determining that public officials with special status in the penitentiary administration are permitted to cumulate the statutory 75% wage increase for work performed on weekly rest days, legal holidays, and other non-working days with the rights associated with overtime labor, but strictly limited to hours actually worked that exceed the normal working duration defined by the Labor Code. This decision resolved a procedural dispute regarding the correct application of social security and labor remuneration norms for penitentiary staff, specifically addressing whether the two distinct compensation mechanisms could be stacked. The court's ruling is grounded in the interpretation of Articles 8 and 10(3) of Emergency Government Ordinance No. 90/2017, read in conjunction with Article 13(5) of Emergency Government Ordinance No. 103/2013 and Article IV(1) and (6) of Law No. 79/2018, in contrast to Article 112 of the Labor Code.
