Applicable seniority step for transitional base salary calculation of pre-existing public sector teaching staff under Framework Law No. 153/2017
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting as the Panel for the Resolution of Legal Issues, issued a mandatory precedent ruling that the interpretation of Article 39(6) in conjunction with Article 38 of Framework Law No. 153/2017 requires that the base salary for teaching staff employed prior to the law’s entry into force be calculated using the seniority step of 4 years as specified in the annex to Government Decision No. 38/2017, thereby resolving the preliminary reference raised by the Cluj Court of Appeal. The dispute concerned the determination of public sector salaries for educators under the transitional provisions of the new framework salary law, specifically challenging which seniority scale applies to existing staff during the transition period. The decisive legal basis comprised the interplay between the new Framework Law No. 153/2017 and the previous regulations, specifically the annex to Government Decision No. 38/2017 derived from Emergency Ordinance No. 57/2015, which mandates the use of the 4-year seniority step rather than other potential scales for salary calculation during the transitional phase.
