The High Court of Cassation and Justice dismissed as inadmissible the reference for the solution of a legal question submitted by the Bacău Court of Appeal. The underlying dispute concerned the tax treatment of healthcare benefits, specifically whether the phrase "equivalent value of medicines" in Romanian tax law includes the reimbursement of the personal contribution (co-payment) for medications approved for auxiliary and connected staff of the judiciary and prosecutors' offices, whether active or retired, under the status law and a Government Decision. The reference sought to determine if such co-payments were exempt from taxation under Article 55(4)(e) and Article 29615(e) of the Fiscal Code (Law No. 571/2003) or Article 76(4)(f) and Article 142(e) of the new Fiscal Code (Law No. 227/2015). By rejecting the referral, the appellate court is left to resolve the interpretive issue independently, as the Supreme Court did not provide a mandatory interpretation of the cited tax provisions.
