The High Court of Cassation and Justice, acting through its Complete Bench for Recourse in the Interest of Law, admitted the recourse filed by the Board of Appeal and established a uniform legal interpretation regarding medical residency funding. The dispute centered on whether stipends paid by a medical unit to a medical resident under specific public salary regulations constituted a professional training expense under the Residency Law. The Court ruled that sums paid as residency stipends pursuant to the Emergency Government Order on public sector salary structures do not constitute expenses incurred for professional training under the provisions governing the organization and financing of the residency program. This decision clarified the legal classification of residency stipends, determining they are not categorized as professional training costs under the relevant articles of the Residency Law.
