The Romanian High Court of Cassation and Justice (Criminal Section) dismissed as unfounded the convicted person’s appeal against the Court of Appeal’s decision, which had upheld the trial court’s ruling taking note of the withdrawal of the request for suspension of sentence execution; the dismissal is final, and the appellant was ordered to pay 800,000 lei in judicial costs (with 200,000 lei for court-appointed counsel advanced from the Justice Ministry’s fund). The case concerned a convicted individual’s request under Article 453(a) of the Criminal Procedure Code to suspend execution of a sentence, filed in February 2004, which the appellant later withdrew before the trial court, leading the Court of Appeal to reject his appeal as the withdrawal was effective. The decisive legal basis was Article 453(2) of the Criminal Procedure Code, which lists the prosecutor, the convicted person, and other specified persons as entitled to file the request, and allows the convicted person, as the titular holder, to withdraw it at any time; since the prosecutor had not adopted the request, the lower courts correctly took note of the withdrawal and did not proceed with the merits.

Asupra recursului de față;

453 lit. a) C. proc. pen.

Împotriva deciziei condamnatul a declarat recurs, fără a-l motiva.
