The court dismissed as unfounded the defendant's appeal against an interlocutory order of the Bucharest Court of Appeal maintaining his pre-trial detention, upholding the detention order and ordering the appellant to pay 800,000 lei in judicial costs (with a portion advanced for state-appointed defense). The underlying case involved a conviction for attempted aggravated murder (arts. 20, 174, 175(i), art. 72 Penal Code), for which the trial court imposed 7 years 6 months' imprisonment plus 3 years' deprivation of rights; the appellate court had extended detention on grounds of the offense's gravity. The High Court of Cassation and Justice ruled that grounds for arrest still subsist, thus the challenged order was lawful and well-founded under art. 385¹⁵ para. 2 lit. b Code of Criminal Procedure, making the appeal unsuccessful.

Asupra recursului de față;

175 lit. i), cu aplicarea art. 72 C. pen.
