The High Court of Cassation and Justice rejected as inadmissible the request for a preliminary ruling submitted by the Bucharest Court of Appeal. The dispute concerned the interpretation of substantive civil and insolvency laws to determine whether a state budgetary creditor holding a statutory priority rank qualifies as a "creditor with a right of preference" and whether a private creditor who subrogates to such a position acquires the same statutory priority. The Court declined to resolve the questions regarding the scope of "creditor with a right of preference" under Articles 1596(a) and 2327 of the Civil Code and Articles 5(15) and 161(5) of Law No. 85/2014, as well as the effect of subrogation on priority status under Articles 1593(1) and 1597 of the Civil Code, thereby leaving the matter unresolved by the Supreme jurisdiction.
