The High Court of Cassation and Justice dismissed as inadmissible the referral from the Bucharest Court of Appeal seeking a preliminary ruling on whether the phrase "at the request of the interested party" in Article 142(2) of the Social Dialogue Law No. 62/2011 refers only to signatory parties of a collective labor agreement or to any employee seeking nullity in their own name. The Court ruled that the referral was inadmissible, leaving the underlying appeal pending. The decision was made in a preliminary ruling procedure under Article 521(3) of the Civil Procedure Code, based on the view that the legal question did not meet the admissibility criteria for such a referral.
