The High Court of Cassation and Justice (ICCJ) admitted the appeal in the interest of the law filed by the General Prosecutor and issued a binding decision on the uniform interpretation and application of the law, thereby resolving the jurisdictional conflict in favor of the bankruptcy judge (judecător-sindic). The dispute concerned the competent authority for hearing objections (contestații) against compulsory enforcement measures initiated by budgetary creditors under the final clause of Article 143(1) of Law No. 85/2014, as well as the admissibility of interim relief requests (such as the lifting or suspension of enforcement measures) filed via a presidential order under Article 997(1) of the Civil Procedure Code. Relying on Articles 41(1) and 45(1)(r) and (2) of Law No. 85/2014, read in conjunction with Article 260(1) and (4) of the Fiscal Procedure Code and specific provisions of the Civil Procedure Code, the Court ruled that material competence belongs exclusively to the judge-sindic invested with the insolvency procedure for such objections and that interim relief petitions addressing fiscal enforcement started under the specified insolvency law provision are admissible before that judge.
