The High Court of Cassation and Justice dismissed as inadmissible the reference for uniform case law submitted by the Pitești Court of Appeal, thereby leaving the lower court's position to resolve the legal question without binding national guidance. The dispute centered on whether Article 14(3) of the Framework Law No. 153/2017 applies to teaching staff who obtained the scientific title of doctor to equivalently qualify for a Grade I teaching degree prior to the entry into force of the Law, a reference initiated under Article 521(3) of the Civil Procedure Code. The decisive legal basis for the dismissal is the procedural admissibility requirements for preliminary references in the civil procedure code, which were not met by the filing, as opposed to the substantive interpretation of the transitional provisions in Article 39(5) of Law No. 153/2017 regarding the salarization of public-funded personnel.
