The Supreme Court of Romania (High Court of Cassation and Justice) definitively resolved a referral from the Bucharest Court of Appeal, ruling that where offense (A) is in legal competition with both the first term (B) and the second term (C) of a post-conviction recidivism, the operative outcome requires applying the rules of concurrence of offenses to establish a resultant penalty for offenses (A) and (B), to which the post-conviction recidivism rules are subsequently applied in relation to the penalty for offense (C). The dispute centered on the correct chronological and methodological order for calculating the final penalty when a single offense overlaps with both elements of a recidivism structure, specifically whether recidivism should be applied first to terms B and C or if the concurrence of A and B must be resolved before applying recidivism via term C. The court held that the intervention of recidivism breaks the concurrence between offenses (A) and (C), thereby establishing the legal basis that the penalty for (A) and (B) is aggregated first under the principles of concurrence, with the resulting penalty then subject to recidivism enhancements based on offense (C).
