The Supreme Court of Romania, through its Complete Panel for the Resolution of Questions of Law in Criminal Matters, upheld the procedural request of the Bucharest Court of Appeal to issue a mandatory preliminary ruling on the interpretation of Article 39(1)(c) of the Criminal Code. The dispute concerned the calculation of the cumulative fine penalty in cases of concurrence of offenses where the daily fine amount established for each concurrent offense differed, a situation that created legal uncertainty regarding the resulting sentence. The Court resolved this by establishing a three-step mandatory methodology: first, the cumulative fine is calculated by adding one-third of the total of the other fines to the heaviest fine; second, the total number of fine-days is determined by adding one-third of the total days for the other fines to the maximum number of days assigned to a single offense; and finally, the daily fine amount is recalculated by dividing the resulting cumulative fine by the resulting total number of fine-days. This decision clarifies the application of the Criminal Code regarding the execution of fines in concurrent cases and is binding from the date of its publication in the Official Monitor.
