The High Court of Cassation and Justice, sitting as the Panel for Resolving Questions of Law, admitted the preliminary reference from the Court of Appeal of Oradea and established a binding interpretation that the term "police officer" under Article 257(4) of the Penal Code has a broad meaning encompassing local police officers governed by the Local Police Act, rather than a narrow interpretation limited to national police officers defined by specific national police and status laws. This decision resolves a legal uncertainty regarding the scope of criminal liability for specific offenses applicable to public safety personnel, effectively ruling that local police officers are included in the statutory definition for the purposes of the referenced penal provision. The ruling is mandatory for all lower courts from the date of its publication in the Official Gazette, pursuant to Article 477(3) of the Code of Criminal Procedure, ensuring uniform application of the law across jurisdictions.
