Municipal demolition order restored on remand after appellate court lacked jurisdiction.
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the exception of lack of jurisdiction of the Court of Appeal Alba Iulia, quashed the latter's decision no. 143/A of 3 February 2004, and remanded the case to the Alba Tribunal for competent resolution. The underlying dispute was a municipal authority's action seeking demolition of constructions erected on its land; the first-instance court granted the demolition order, but the Court of Appeal reversed and dismissed the claim. The Court held that because the first-instance judgment was rendered under Art. 282¹ of the Civil Procedure Code, which exempts such decisions from appeal, the Court of Appeal lacked appellate jurisdiction; accordingly, under Art. II point 1 of Law No. 195/2004, the decision was quashed and the matter reassigned to the Tribunal.

Asupra recursului de față;
