Preliminary reference on extradition specialty rule for concurrent convictions declared inadmissible
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible a preliminary reference request from the Timiș Tribunal concerning the interpretation of the specialty rule in international criminal judicial cooperation. The dispute arose in a criminal extradition case where the requesting state had refused extradition for one of several concurrent offenses for which the person had been convicted, leaving unresolved whether the sentence for the refused offense must be executed after the completion of the sentence for the admitted offense. The Court determined that the request did not meet the admissibility requirements under Article 477 of the Code of Criminal Procedure, specifically failing to provide the necessary legal basis for resolving the question regarding the application of Article 117(2) of Law No. 302/2004, which stipulates that a surrendered person shall not be prosecuted or detained for another prior offense without the consent of the executing state.
