Scope of criminal liability for entrusting a vehicle to a driver under alcohol influence: requirement of blood alcohol concentration exceeding 0.80 g/l under Article 335(3) of the Penal Code
Legislator summary
AI generatedThe Supreme Court of Romania, acting through its Complete Panel for Resolving Questions of Law, resolved a preliminary reference question by determining that under Article 335(3) of the Penal Code, the crime of entrusting a vehicle to a person under the influence of alcohol is only established when the recipient has a blood alcohol concentration exceeding 0.80 g/l. This decision prevails as the mandatory legal interpretation for all courts from the date of publication in the Official Monitor, effectively narrowing the scope of criminal liability to cases of high-level intoxication rather than any degree of alcohol presence. The dispute, initiated by the Oradea Court of Appeal in a criminal case, centered on whether the specific subjective knowledge element required for this offense applies to any detectable level of blood alcohol or strictly to the threshold associated with drunk driving. The decisive legal basis is the interpretation of Article 335(3) of the Penal Code in conjunction with the procedural mechanism of preliminary references under Article 477 of the Code of Criminal Procedure.
