The High Court of Cassation and Justice, ruling as a panel for the preliminary resolution of questions of law, dismissed as inadmissible the referral from the Cluj Tribunal, thereby refusing to issue a preliminary ruling on whether the penalty for unauthorized construction works under art. 26(1)(a)-(b) of Law No. 50/1991 can be applied at any time as a continuing offense or whether the limitation period under art. 31 begins to run from the material commission of the act. The dispute involved the interpretation of art. 37(5) of the same law in the context of a building-authorization enforcement case, and the decisive legal basis was procedural; the court found the referral inadmissible under the applicable rules governing preliminary rulings, with the decision rendered binding pursuant to art. 521(3) of the Civil Procedure Code.
