The High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary ruling submitted by a Court of Appeal, thereby leaving the lower court's case pending without providing a binding interpretation on the disputed issues. The dispute concerned the interpretation of the statutory provision for public servants' status (Article 86(3) of Law No. 188/1999) regarding the meaning of "salary rights," specifically whether this provision must be completed by Article 52(2) of the Labor Code (Law No. 53/2003) and if the phrase "other rights" therein encompasses seniority in work, specialty, public office, and rest leave. The decisive legal basis was Article 521(3) of the Code of Civil Procedure, under which the court determined the submission did not meet the admissibility requirements for a decision on questions of law.
