The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference submitted by the Bucharest Court of Appeal regarding the interpretation and application of specific wage supplement provisions. The dispute concerned the eligibility of personnel in public veterinary and food safety institutions for a hazard bonus of up to 35% under Law No. 153/2017, specifically questioning the intersection of Annex VIII, Chapter II, item 6.2(a)(1) with Article 38 of the same law. The court's decision was based on the procedural requirement that a reference for a preliminary ruling on questions of law must be admissible under Article 521(3) of the Code of Civil Procedure, resulting in the rejection of the request without a substantive ruling on the interpretation of the wage supplement norms.
