The High Court of Cassation and Justice resolved a negative conflict of jurisdiction in favor of the Galați Tribunal, ordering it to hear the labor dispute. The case involved a claim by a former employee against a company for the updating of overdue salary payments and guarantees, following prior judgments by Constanta courts that had ordered reclassification and back pay. The core procedural issue was whether the claim constituted a "contestation of the enforcement title" (which would fall under the jurisdiction of the issuing courts in Constanta) or a new set of claims arising after the title was issued. The Court held that the dispute did not concern the interpretation or scope of the existing enforcement title, but rather new subsequent claims for updated sums, thereby precluding the jurisdiction of the Constanta courts under the rules for enforcing judgments. Consequently, applying Article 5 of the Civil Procedure Code regarding subject matter jurisdiction, the Court affirmed the competence of the Galați Tribunal as the first-instance court for the current action.

DECIDE:

Stabilește competența de soluționare a acțiunii formulate de reclamantul I.F. împotriva pârâtei SC A.R. SA Galați în favoarea Tribunalului Galați.

Pronunțată în ședință publică, astăzi 29 octombrie 2004.
