The High Court of Cassation and Justice rejected as inadmissible the preliminary reference submitted by the Alba Iulia Court of Appeal regarding the jurisdiction of a criminal judge in corruption cases. The dispute centered on whether a judge previously designated as the head of a specialized corruption panel, but subsequently not re-designated by the court's administrative college during a period when no such panels were active, retained the competence to try newly assigned corruption cases, and if not, whether the resulting defect constituted relative or absolute nullity. Relying on Article 477(3) of the Code of Criminal Procedure and the specific conditions for preliminary references under Article 29(1) of Law No. 78/2000, the Court determined that the question did not meet the statutory requirements for a binding ruling on a question of principle, thereby leaving the procedural status of the underlying case undetermined by this specific decision.
