The High Court of Cassation and Justice (Supreme Court) of Romania, sitting as the Plenary for the Resolution of Legal Issues in Criminal Matters, answered a reference from the Cluj Court of Appeal by establishing that the provision allowing for the withdrawal of conditional release and revocation of the remaining term applies both to offenses committed prior to the conditional release but discovered during the supervision period and to offenses committed and discovered prior to the conditional release. The dispute concerned the interpretation of the Romanian Criminal Code's conditions for revoking conditional release, specifically whether the statutory language regarding offenses "committed before the granting of release" and "discovered during the supervision period" excludes cases where the discovery occurred before the release was granted. The decisive legal basis was the interpretation of Article 105(1) of the Romanian Criminal Code, where the Court clarified that the phrase "if during the supervision period it is discovered that the convicted person had committed another offense prior to the granting of the release" encompasses both scenarios, thereby broadening the scope of grounds for withdrawing conditional release to include previously discovered pre-release offenses.
