The High Court of Cassation and Justice, in its full bench for resolving legal issues, admitted the appeal filed by the Craiova Court of Appeal and issued a binding interpretation under Art. 521(3) of the Code of Civil Procedure, establishing that compensation set by a final judgment under Law no. 255/2010 (prior to its 2018 amendment) is incompatible with the award of interest for late payment under Art. 1535 of the Civil Code for the period between the property transfer date and the finalization of the judicial challenge regarding the compensation amount. However, the Court ruled that such interest is compatible and may be awarded for the period following the finalization of the judicial procedure prescribed by Art. 22(1) of Law no. 255/2010. This decision clarifies the temporal scope of statutory interest in expropriation cases for public utility, resolving conflicts arising from the interplay between Law no. 255/2010, Law no. 33/1994, and the Civil Code.
