The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Brăila Tribunal Civil Court, leaving the procedural matter unresolved at the appellate level. The dispute concerned whether a loan agreement, which holds the status of an enforceable title under the Emergency Government Ordinance No. 99/2006, is subject to the public registry inscription requirement for private-signed documents established by Article 641 of the Civil Procedure Code, or if that requirement applies strictly to instruments where another norm expressly mandates inscription for enforceability. The Court determined the referral inadmissible pursuant to Article 521(3) of the Civil Procedure Code, thereby refusing to interpret the scope of the registration mandate for credit contracts versus general private instruments.
