The High Court of Cassation and Justice dismissed as inadmissible a preliminary reference submitted by the Cluj Court of Appeal regarding the interpretation of the "field in which the degree is held" criterion under Romanian Law No. 153/2017. The dispute concerned whether the 50% monthly allowance for public sector employees holding a PhD must be assessed against the official Nomenclature of university domains or the specific duties outlined in the employee's job description. By rejecting the referral, the court resolved the procedural dispute in favor of the opposing parties, leaving the matter to be decided by the lower court without a binding supreme court interpretation; this decision stands as the final operative outcome. The key legal issues involved the scope of the salary framework law for public funds and the admissibility requirements for requests to settle questions of law under Article 521(3) of the Civil Procedure Code.
