The High Court of Cassation and Justice, in its Full Court for the resolution of legal issues, dismissed as inadmissible the preliminary reference submitted by the Brașov Court of Appeal, thereby preventing the issuance of a binding interpretative decision and leaving the lower court's proceedings unaffected regarding the legal question at hand. The dispute concerned the interpretation and application of the 15% salary supplement for persons with disabilities under specific government regulations, with the referring court seeking clarification on how this provision interacts with the framework salary law for public-sector employees. The Court's decision was grounded in procedural admissibility standards under Article 521(3) of the Civil Procedure Code, focusing on the formal requirements for initiating a preliminary reference regarding the interpretation of Article 22(2) of Law No. 153/2017 and Government Decision No. 751/2018, rather than addressing the substantive rights of the plaintiffs in the underlying administrative-tax litigation.
