The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference (hotărâre prealabilă) submitted by the Timișoara Court of Appeal, thereby leaving the lower court to resolve the issue without a binding legal clarification from the supreme jurisdiction. The underlying dispute concerned the conflict of laws regarding the specific legislative regime applicable to public funding for sports associations, clubs, and county sports federations, with the referring court seeking clarification on whether local budget allocations should be governed by the Government Ordinance on associations and foundations, the Sports Education and Sport Law, or the Public Administration Law. The decision was based on the procedural inadmissibility of the reference, rejecting the court's request to interpret Article 46(1) of O.G. 26/2000 in conjunction with Articles 69, 71, and 72 of Law 69/2000 and Law 215/2001 to determine the correct legal basis for financing these entities.
