The High Court of Cassation and Justice dismissed as inadmissible the referral from the Timișoara Court of Appeal seeking a preliminary ruling on whether a beneficiary of a non-reimbursable financing contract is entitled to moratory damages when a budgetary claim act issued under Government Emergency Ordinance No. 66/2011 (concerning irregularities in EU and national funds) is annulled after the beneficiary repaid the sums, and whether moratory damages are owed for late payment tranches. The court held the referral inadmissible, meaning no preliminary ruling was issued and the underlying appellate case remains pending before the referring court. The dispute arose in administrative litigation (contencios administrativ) over the annulment of an irregularity and budgetary debt determination act and the resulting financial consequences. The decision was based on procedural grounds under Article 521(3) of the Civil Procedure Code, which governs the binding effect of preliminary rulings, and the referral was deemed to fail the admissibility requirements for such a mechanism.
