The High Court of Cassation and Justice admitted a preliminary ruling request, establishing that holders of the "Liberation Fighter with Determining Role" title are exempt from paying health insurance contributions on indemnities received under Law No. 341/2004. This decision resolves a conflict regarding the interpretation of Article 5(2) of Law No. 341/2004, read in conjunction with Article 3(1)(b)(3), in relation to the tax exemptions provided by Article 154(1)(d), Article 155, and Article 114 of the Fiscal Code (Law No. 227/2015) and Article 224(1)(d) of the Health Reform Law (Law No. 95/2006). The court definitively determined that the specific nature of the indemnities for the December 1989 Revolution, the 1987 Brașov revolt, and the 1977 Jiu Valley revolt places them outside the scope of mandatory health insurance contributions, thereby clarifying the tax and social security status of these legislative benefits.
