The High Court of Cassation and Justice rejected as inadmissible the reference for a uniform application of the law submitted by the Court of Appeal, leaving the lower court to resolve the case without a preliminary ruling. The dispute concerned the interpretation of Emergency Government Order No. 9/2017 (approved and amended by Law No. 115/2017) regarding budgetary measures for 2017, specifically whether the risk and neuropsychic overstrain allowance mentioned in Article 1(3) falls within the category of allowances whose amounts are maintained for the period of March 1 to December 31, 2017, as referenced in Article 1(1), with implications for budgetary inclusion under the National Agency for Fiscal Administration. The decision rests on procedural grounds of inadmissibility pursuant to Article 521(3) of the Code of Civil Procedure, which governs the conditions for the competent panel to address questions of law for the uniform application of legislation.
