The High Court of Cassation and Justice dismissed as inadmissible the preliminary ruling request filed by the Court of Appeal, with the decision being mandatory under Article 521(3) of the Civil Procedure Code. The dispute arose from a civil procedure where the referring court sought clarification on whether Article 539 of the Code of Criminal Procedure applies exclusively to preventive measures or also covers the illegality of detention occurring after a final criminal conviction, specifically whether such illegality must be explicitly established by a final court decision and if this includes cassation appeals. The operative outcome is the refusal to provide the requested legal interpretation due to the inadmissibility of the referral, leaving the procedural status quo intact without resolving the underlying question of criminal detention legality post-conviction.
