The High Court of Cassation and Justice, in its full composition for resolving questions of law, admitted the referral from the Court of Appeal and issued a binding interpretation, determining that the renunciation of set-off is compatible with insolvency proceedings unless the set-offtable claim belongs to the creditor entitled to request the opening of the insolvency procedure, while also clarifying that a creditor listed in the creditors' mass may invoke legal set-off against an insolvent debtor if they can prove prejudice caused by the debtor’s or the insolvency practitioner’s refusal or negligence in exercising that right. This decision resolved a conflict of law regarding the interaction between civil law set-off mechanisms and insolvency proceedings, specifically addressing whether the automatic freezing of individual enforcement actions in insolvency precludes the mutual extinction of reciprocal debts. The ruling established that set-off remains admissible under specific conditions, relying on the interplay between Article 90(1) and (2) and Article 5 point 20 of Law No. 85/2014 concerning insolvency prevention and insolvency procedures, combined with Articles 1.617(1) and (3) of the Civil Code regarding the legal set-off of reciprocal debts.

În interpretarea şi aplicarea dispoziţiilor art. 90 alin.
