The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Bucharest Court of Appeal, thereby leaving the lower court to resolve the matter without a supreme court interpretation. The dispute involved a procedural challenge regarding the interpretation of Article 55(3) of Law No. 293/2004 concerning the Status of Public Officials with Special Status in the Penitentiary Administration, specifically whether a daily unit decision assigning specific managerial duties could be legally assimilated to a formal delegation of authority for a managerial function as required by the statute. The decisive legal basis for the dismissal was the procedural inadmissibility of the referral under Article 521(3) of the Code of Civil Procedure, meaning no substantive ruling on the specific statutory interpretation was issued.
