Preliminary ruling on applicability of forestry and EU timber circulation regulations to road transport of wood waste and sawdust under divisible goods rules
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible a reference for a preliminary ruling requested by the Caras-Severin Tribunal, thereby refusing to clarify the legal question and leaving the procedural request unresolved. The dispute concerned whether specific forestry and timber circulation regulations, including definitions from the Forestry Code and norms implementing EU Regulation 995/2010, apply to the transport of divisible goods such as wood waste, sawdust, and chipped wood under the Road Transport of Goods Regulation (H.G. 1373/2008), specifically questioning if the operator obligations under Article 5 of that regulation were triggered. The decisive legal basis for the dismissal was the procedural rules governing references for preliminary rulings under Article 521 paragraph (3) of the Civil Procedure Code, resulting in the rejection of the appeal and the maintenance of the lower court's position regarding the admissibility of the question.
