Inadmissible reference on whether radiological risk categories III and IV automatically qualify for reduced pension insurance periods
Legislator summary
AI generatedThe Supreme Court of Cassation and Justice dismissed the preliminary reference for interpretation submitted by the Court of Appeal of Constanța as inadmissible, thereby refusing to rule on the substantive legal question and leaving the lower court to resolve the matter without a binding interpretive precedent. The dispute concerned the interpretation of pension entitlements under the public pension system, specifically whether employees who completed at least 15 years in risk categories III and IV for radiological exposure are automatically entitled to a reduced mandatory insurance period under the interpretation of Article 57(1) of Law No. 263/2010, or if this benefit is restricted exclusively to those who effectively performed activities in Zone I work environments as defined by Government Decision No. 583/2001 and Article 30(1)(b) of the same law. The decision is grounded in procedural law, specifically Article 521(3) of the Civil Procedure Code, which governs the admissibility of preliminary questions referred to the Plenary for resolving legal disputes.
