The High Court of Cassation and Justice admitted the referral and ruled, as a preliminary ruling binding upon publication in the Official Gazette, that a witness who is a denouncer benefiting from the non-punishment cause under Article 290(3) of the Penal Code can be an active subject of the offense of false testimony under Article 273(1) of the Penal Code; the court thus resolved a question of criminal law raised by the Bacău Court of Appeal regarding the intersection of the non-punishment cause for denouncers and liability for false testimony, clarifying that such a witness is not exempt from prosecution for false testimony despite the immunity granted by the denunciation provision.
