Interpretation of continued special protection for students changing faculties under Law 272/2004
Legislator summary
AI generatedThe High Court of Cassation and Justice ruled in favor of the referring appellate court’s request, establishing a mandatory legal interpretation that resolves the dispute over the continuity of state benefits for students. The case concerned whether a child under special protection who enrolls in a new faculty or specialization retains eligibility for benefits when the initial undergraduate program is not yet completed. The Court interpreted Article 55(2) of Law No. 272/2004 on the protection and promotion of children’s rights, determining that the phrase "if they continue their studies only once in each form of day schooling" allows the beneficiary to maintain special protection provided the initial university license program, as defined by Article 140(1) of the National Education Law No. 1/2011, has not been finalized.
