The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling on a question of law submitted by the Tribunal of Dolj, thereby leaving the lower court to resolve the procedural issue. The dispute centered on whether a first-instance court order rejecting a claim for the fixing of a definite amount of contractual penalties, issued under Article 906(4) of the Civil Procedure Code, is subject to an appeal. The decisive legal basis was the procedural requirement for a preliminary reference under Article 521(3) of the Civil Procedure Code, which the referring court failed to satisfy, rendering the referral inadmissible.
