The High Court of Cassation and Justice (ICCJ) dismissed as inadmissible the request for a preliminary ruling submitted by the Cluj Court of Appeal, leaving the lower court to resolve the matter without binding supreme court guidance. The dispute arose within insolvency proceedings initiated under Law No. 85/2006, specifically concerning three issues: whether individual forced execution measures apply to claims predating the collective insolvency procedure, whether the unique insolvency account is subject to attachment in individual execution, and whether individual execution initiated by holders of current claims falls under the jurisdiction of the syndic judge. The ICCJ’s decision to reject the referral was grounded in procedural law, specifically Article 521(3) of the Code of Civil Procedure, which governs the admissibility of questions referred for the resolution of legal questions.
