The High Court of Cassation and Justice (Civil Section I) declined its jurisdiction and transferred the case to the Galați Court of Appeal, which prevails on this procedural point. The applicant had sought the transfer (strămutare) of case file x/2017 from the Brăila District Court to another court of equal level, citing legitimate suspicion (bănuială legitimă) of bias. Because the underlying case was filed after the New Code of Civil Procedure took effect and the Brăila District Court falls within the territorial jurisdiction of the Galați Court of Appeal, the High Court held, under Articles 131 and 142(1) of the Code of Civil Procedure, that the Galați Court of Appeal—not the High Court—is the materially competent court to decide the transfer request. The decision is final and without appeal.
